SwapCircle – Terms of Use

Welcome to SwapCircle. We know Terms & Conditions aren’t exciting, but they matter. These Terms explain how SwapCircle works, what we expect from users, and what you can expect from us. By using SwapCircle, you agree to these rules.

If you do not agree with these Terms, please do not use the platform.

1. What is SwapCircle?

SwapCircle is an online marketplace that helps people in Uganda buy and sell quality pre-owned items.

    • We do not own, sell, or buy any items listed.
    • We do not handle payments between buyers and sellers.
    • We simply provide the platform that connects people.

All transactions happen directly between users.

2. Who Can Use SwapCircle?

By using SwapCircle, you confirm that:

    • You are 18 years or older
    • The information you provide is true and accurate
    • You have the legal right to sell the item you list
    • You will use the platform lawfully and responsibly

Accounts are personal and non-transferable.

3. Registration & Accounts

To post or interact fully on SwapCircle, you must create an account.

You agree to:

    • Keep your login details secure
    • Use only one account
    • Notify us if you suspect unauthorized access

SwapCircle is not responsible for losses caused by misuse of your account.

4. Listings & Posting Rules

When posting an item, you agree that:

    • The item is real, owned by you, and accurately described
    • Photos reflect the actual item, not stock images
    • Prices are honest and not misleading
    • One listing = one item (no bulk spam ads)

Prohibited Listings (examples)

You may NOT list:

      • Illegal items under Ugandan law
      • Stolen goods
      • Drugs, weapons, or counterfeit items
      • Explicit adult services or content
      • False, duplicate, or misleading ads

SwapCircle reserves the right to remove any listing that violates these rules.

5. Paid Listings & Promotions

SwapCircle may charge:

    • A listing fee to publish an item
    • An optional promotion fee (Featured listings)

Important notes:

      • Fees are clearly shown before payment
      • Fees are non-refundable once a listing goes live
      • Paying does not guarantee a sale, only visibility

These fees help keep SwapCircle clean, trusted, and spam-free.

6. Buying & Selling Responsibility

Buyers and sellers are fully responsible for:

    • Inspecting items before paying
    • Agreeing on price and delivery
    • Meeting safely and responsibly
    • Completing transactions off-platform if needed

SwapCircle is not a party to the transaction and does not offer escrow or buyer protection at this time.

7. Reviews & “Mark as Sold”

    • Buyers may leave honest reviews after a real interaction
    • Reviews must be factual and respectful
    • Fake or abusive reviews will be removed

Sellers are encouraged to mark items as “Sold” once completed to keep the marketplace accurate.

8. Safety & Reporting

SwapCircle provides tools to:

    • Report listings
    • Report users
    • Flag suspicious behavior

We may investigate and take action, including:

    • Removing listings
    • Suspending accounts
    • Permanently banning repeat offenders

We are not obligated to explain every moderation decision.

9. Content Ownership

    • You own the content (photos, descriptions) you upload
    • By posting, you grant SwapCircle permission to:
      1. Display your content
      2. Promote it within the platform
      3. Use it for marketing (without selling it to third parties)
    • You may not copy, scrape, or reuse SwapCircle content without permission.

10. Platform Availability

We strive to keep SwapCircle running smoothly, but we do not guarantee:

    • Continuous availability
    • Error-free operation
    • Uninterrupted access

We may update, suspend, or modify features at any time.

11. Limitation of Liability

SwapCircle is not responsible for:

    • Losses, damages, or disputes between users
    • Fraud, misrepresentation, or failed transactions
    • Data loss or service interruptions beyond our control

Use SwapCircle at your own risk.

12. Account Suspension & Termination

We may suspend or terminate accounts if you:

    • Break these Terms
    • Repeatedly receive complaints
    • Post illegal or fraudulent content
    • Abuse the platform or other users

You may stop using SwapCircle at any time.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of SwapCircle after updates means you accept the changes.

14. Governing Law

These Terms are governed by the laws of the Republic of Uganda. Any disputes related to SwapCircle shall be handled in Ugandan courts.
